1. Who we are

2. Definitions

User – anyone who accesses the Site.
Client – the individual or legal entity that requests a quote, orders a car or signs a contract with BrokerAuto.
Consumer – a Client who is an individual acting for purposes outside their trade, business, craft or profession.
Request – any enquiry sent through the Site’s forms, by phone, WhatsApp or e-mail (quote request, order from Germany, financing, Buy Back valuation, viewing appointment, contact).
Contract – the written sale or services contract signed between BrokerAuto and the Client.

3. Acceptance of these terms

By accessing and using the Site you accept these Terms and conditions. If you do not agree with them, please do not use the Site. These Terms are supplemented by the Privacy and cookies policy, by the Contract we sign with you and by Romanian law in force, in particular Law no. 365/2002 on electronic commerce and Government Emergency Ordinance no. 34/2014 on consumer rights. Where these Terms and the Contract differ, the Contract prevails.

4. Our services

BrokerAuto is a multi-brand car dealer. Through the Site we present:

new and used cars available in stock;
cars we bring to order from Germany and other European Union countries;
help with financing (leasing or loan) through partner financiers;
taking over your current car (Buy Back), as part-payment or separately;
related services: registration, transport, extended warranties, insurance through partners;
free Site features: favourites, comparison, price and stock alerts by e-mail.

The Site is for presentation purposes. We do not sell cars exclusively online: every sale is based on a written Contract, usually signed at the showroom or through documents signed by both parties.

5. Information on the Site

We make every effort to keep the information about the cars (features, equipment, mileage, prices, availability) accurate and up to date. It is, however, for information only and may contain technical or human errors, including when it comes from our suppliers. Photos may be illustrative and equipment may differ depending on the version.

If a price or feature was displayed incorrectly, we will tell you the correct information before the Contract is signed and you decide whether to accept the updated offer. We are not obliged to sell at a price displayed in error that is obviously lower than the real price. Before making a decision, please check the specifications with a sales consultant.

6. Prices

Prices are shown in euro. For cars with deductible VAT we show both the price without VAT and the price including VAT (21%). For cars sold under the special margin scheme (non-deductible VAT), the price shown is the final price. The final price, the payment currency and the applicable exchange rate are those stated in the written offer, pro forma invoice or Contract.

Monthly payments shown are estimates, calculated for a reference down payment, term and interest rate. They are not a financing offer: the actual terms depend on your profile and on the financier’s decision.

7. Requests, offers and orders

Sending a form or a message does not create a contractual obligation for BrokerAuto, nor a commitment to transfer ownership of a car. Every Request goes through a check of availability, features and price. A consultant will contact you to confirm the details and send you an offer.

Contractual obligations begin when BrokerAuto confirms the order in writing and the Contract is signed or, as agreed, when we start purchasing the car for you.

8. Cars in stock and to order

Cars marked “In stock” can be viewed and delivered after the Contract is signed and the price is paid, under the agreed terms. Availability may change between the time a car is displayed and the time of your Request; in that case we will propose similar options, which you are free to accept or decline.

For cars brought to order, the delivery times shown (for example 5–10 working days) are estimates and may vary for reasons beyond our control (supplier, transport, formalities). A firm order is placed on the basis of a Contract, which may require a down payment. The conditions for refunding the down payment are those set out in the Contract.

9. Payment

Payment is made by bank transfer to the accounts listed in section 1, through financing (leasing or loan) or by other methods set out in the Contract. Cash payments are accepted only within the limits set by law. Ownership of the car passes after the price is paid in full, unless the Contract provides otherwise.

10. Financing

BrokerAuto is not a credit institution or a non-bank financial institution. We help you prepare the paperwork and, with your consent, send it to partner financiers. Approval of the financing, the interest rate, the minimum down payment, the costs and all final conditions belong exclusively to the financier and are those in the contract you sign with them.

11. Buy Back – taking over your car

A valuation given online or by phone is indicative. The final buy-back price is set after a physical inspection of the car and a check of its documents and history. You confirm that you own the car or are entitled to dispose of it, and that you tell us its condition truthfully (damage, mileage, liens or restrictions).

12. Handover and registration

The car is handed over at the showroom or at the agreed address, with a signed handover report. At handover, please check the car and its documents and tell us immediately about any visible non-conformity. Transport and registration are provided on request, under the terms and costs in the written offer.

13. Warranty and conformity

Cars come with the warranty required by law. For Consumers, we are liable for lack of conformity under the conditions and within the periods set by Government Emergency Ordinance no. 140/2021. Separately, we may offer a commercial or extended warranty (up to 24 months), under the conditions in the warranty certificate or the Contract. The warranty does not cover normal wear and tear, improper use, accidents or work carried out outside the authorised network. For Clients that are legal entities, the Contract applies.

14. Right of withdrawal

Contracts signed at the showroom, in the presence of both parties, are not distance contracts, so the 14-day right of withdrawal for distance contracts does not apply.

If, exceptionally, a Contract with a Consumer is concluded exclusively at a distance, the Consumer may withdraw within 14 days of taking possession of the car, without giving a reason, under the conditions and with the exceptions set by Government Emergency Ordinance no. 34/2014. The withdrawal must be sent to the e-mail address in section 1. The direct costs of returning the car are borne by the Consumer, and the amounts paid are refunded within 14 days of the withdrawal notice. The refund may be withheld until the car has been returned. The Consumer is liable for any loss in the car’s value resulting from handling or use beyond what is needed to establish its nature, characteristics and functioning.

15. Free Site features

Favourites, comparisons and recent searches are stored only in your browser. E-mail alerts (new cars matching your search, price drops) are sent only after you subscribe, and you can stop them at any time using the unsubscribe link in every e-mail. We do not guarantee that these features will work without interruption.

16. Fair use of the Site

Please do not use the Site for unlawful purposes, send false data or other people’s data without their consent, attempt unauthorised access to our systems, or automatically extract the Site’s content (scraping) without our written consent.

17. Intellectual property

The Site’s content (text, photos, video, graphics, logo, structure) belongs to CAR AND LEASE BROKER SRL or its partners and is protected by copyright and trademark law. Copying, reproducing or using it commercially without our written consent is prohibited. Car brands belong to their owners and are used only to identify the products.

18. Limitation of liability

We are not liable for interruptions or technical errors of the Site, for the content of third-party websites linked from the Site, or for decisions made solely on the basis of the Site’s indicative information without confirmation from a consultant. This limitation does not affect the rights the law grants to Consumers.

19. Personal data

We process your personal data in accordance with Regulation (EU) 2016/679 (GDPR). The details are in the Privacy and cookies policy.

20. Force majeure

Neither party is liable for failing to perform its obligations because of force majeure, as provided by law. The party invoking it must notify the other as soon as possible.

21. Complaints and dispute resolution

For any complaint, write to us at office@brokerauto.ro or call 0743 300 500. We reply as soon as possible, usually within 30 days at most. We always try to settle any disagreement amicably first.

Consumers may also contact the Romanian National Authority for Consumer Protection (anpc.ro) and use the alternative dispute resolution procedure (SAL). Disputes that cannot be settled amicably are resolved by the competent courts in Romania.

22. Final provisions

These Terms are governed by Romanian law. We may update them at any time; the version in force is the one published on this page when you use the Site, and changes do not affect Contracts already signed. This English version is provided for information; in case of any discrepancy, the Romanian version prevails.
